Legislation on the receipt of EVD by persons with disabilities

The accrual of monetary compensation is regulated by legal documents of the federal level, a brief summary of which is presented in the table:

General requirements for disability 2 groups

Restrictions of the 2nd group are assigned with pronounced deviations in health with preserved self-service skills:

• Indefinitely, if the underlying disease is incurable;
• For a certain period of time, after which the citizen is required to undergo a re-examination.

Deviations in health occur:

• In the presence of chronic or infectious diseases of the lungs, liver, heart, nervous and musculoskeletal systems;
• After organ transplant.

Who is assigned group 2

The second group is established in the presence of a whole range of indications:

1. Partial restriction in self-service, movement, communication;
2. Loss of objective perception of reality and self-control;
3. The need for training under a special program or the creation of special working conditions.

With incapacity since childhood

Restrictions in self-care, movement, communication, the need for care by another person in the presence of a pronounced health disorder is the main reason for recognizing a child as disabled. Previously, the legal status “disabled since childhood” was applied to them, since 2014, upon reaching the age of majority, a disabled child receives a document establishing a certain category: 1, 2 or 3.

Minors

An illness or injury that led to a child's disability is not only congenital or postpartum. They can develop or arise in the process of growth and development. The procedure for assigning a preferential category is similar to an adult: after passing the ITU, a set of documents is sent to the Pension Fund of the Russian Federation to register the status and accrue the payments required by law.

Combat veterans

Participants in local conflicts are already beneficiaries, however, having lost a limb as a result of military operations, they can be recognized as disabled of the second group.

Service duties of military personnel can adversely affect their health. The assignment of the second group occurs on a general basis, however, before passing the ITU, the applicant must receive the conclusion of the medical military commission on the relationship between service and the injury received.

How much do disabled people of the 2nd group pay in 2019

Measures of material and social support for persons with disabilities are designed to improve their living conditions. The monthly amount of funds received is calculated individually, taking into account a number of parameters:

• The age of the disabled person;
• Number of years worked;
• Dependent data;
• Replacing social services with cash equivalents;
• Reason for assigning disability, etc.

What is the monthly payment made of?

The amount of payments accrued every month is formed from material compensation, the amount of which for 2019 consists of the components presented in the table.

Privileges for disabled people of the 2nd group

Inadequate health, partial loss of self-service skills, the need for the support of others determine a set of preferences for people with disabilities in this category:

1. Teaching a profession in a budgetary place with an increased scholarship;
2. Avoidance of paying property tax;
3. Reduced transport tax;
4. Free travel around the city and to the place of restoration;
5. Compensation for expenses for housing and communal services and telephone;
6. Provision of medicines and prostheses.

Subjects caring for them also receive benefits. These are sanatorium courses partially paid from the budget, gratuitous use of public transport, payment for care.

Who has a higher pension

The amount of the pension exceeds the standard payment for disability group 2 for:

• Employees from the Far North (even if at the time of appointment they live in Moscow or another region of Russia);
• Employees in the Armed Forces of the Russian Federation;
• Participants of the Second World War and blockade;
• astronauts;
• Liquidators of man-made disasters.

Will there be indexing?

State subsidies are regularly indexed. However, the increase in 2016 was incomplete, and expectations were not met in 2017 either.

Now indexing is carried out according to the schedule:

• From January 01– insurance pensions by 3.7%;
• From February 01– EDV by 2.5%;
• From 01 April– social pensions by 4.1%.

Algorithm for calculating payments

It is possible to receive the cash payments laid down by law in several stages:

1. Collection of necessary papers;
2. Transfer them to the department of the Pension Fund of the Russian Federation;
3. Calculation of the amount of pensions, UDV, other compensations and benefits;
4. Opening an account (if necessary);
5. Registration of legal status and transfer of money.

The amount of social pensions is legalized and is only going through the procedure of annual indexation. When calculating the insurance pension, the total amount depends on the unique coefficient (the number of accumulated points) and the number of dependents in the family.

The value of the UCW takes into account the refusal of a set of social services and is:

• RUB 2590.24 - with a complete rejection of social services;
• RUB 1515.05 - while maintaining a full range of social services.

An intermediate option is possible, when the refusal occurs only from a certain part of the composition of the social set.

Minimum set of documents

The set of papers for obtaining privileges and monetary compensation is as follows:

• Applicant's passport;
• Reference-conclusion of the ITU;
• Proof of experience;
• Information about dependents;
• Information about the number of tenants in the apartment;
• Payment documents for gas, electricity, heating, water.

The last two documents are required to calculate compensation for utility costs.

How and where to get a medical examination

The main document that allows the use of preferences and UDV is the ITU reference-conclusion (medical and social expertise).

The verification procedure consists of the following steps:

1. Diagnosis and examination of attending physicians in the clinic at the place of observation;
2. Passage according to the schedule of the medical commission;
3. Doctors carefully study the papers and issue a verdict;
4. The commission decision is issued with a certificate for up to one year for presentation to the USZN, PF, etc.

The medical examination procedure must be repeated before the expiration of the previous certificate. The limitation of the disability is not reflected in the amount of payments.

Is it possible to re-qualify a disability of 2 groups

Russian legislation allows for the possibility of retraining the established group for a more “light / heavy” degree or its removal.

The procedure does not differ from the standard procedure for passing the ITU at the first establishment:

1. Diagnosis and examination by narrow specialists in the clinic at the place of attachment;
2. Passage of ITU;
3. Drawing up a conclusion taking into account the opinion of the members of the commission;
4. Sending a set of documents to the branch of the Pension Fund of the Russian Federation.

What are the ways to submit documents

It will not be possible to pass a medical examination in absentia, but in the case of the appointment of cash payments, the Pension Fund provides for the following options for receiving documents from citizens:

• Personally - when visiting the nearest branch by a disabled person or his representative;
• By mail - when sending a registered letter with a return receipt and a description of the attachment;
• MFC - when visiting the nearest point;
• On the official website of the Pension Fund of the Russian Federation;
• In a personal account on the Internet resource of the State Services.

Features of "working" and "non-working" disability groups

The concepts of “working” and “non-working” groups are not fixed by regulatory acts, since when certain conditions are created, the restriction does not interfere with the performance of the labor function. In practice, employment at the enterprise is possible with a reduced day length and taking into account the severity of the underlying disease.

A number of injuries in the second group are traditionally classified as non-working, although a person may well work remotely - as a dispatcher on the phone, for example.

Thus, the establishment of the second group of disability is carried out according to the standard algorithm. The subject has the right to the appointment in 2019 of a pension (social or insurance), a monthly cash payment, compensation for utility costs. The ITU conclusion is limited in validity and requires annual re-examination.
